Hearing Summary

The Metropolitan Transportation Authority (“MTA”), on behalf of itself and its subsidiaries, will hold a public hearing pursuant to Article 2 of

the New York State Eminent Domain Procedure Law (“EDPL”) on the proposed acquisition of permanent property interests in properties in the County of Westchester for the Metro-North Upgrade Automotive Fuel System Project (“Project” or “AFS”). The hearing will review the public uses, benefits, purposes, and location of the Project, the impact the Project may have on the environment and residents of the area, and will give the public an opportunity to comment on the Project and the proposed Property acquisition.

Description of the Project

Metro-North’s AFS Project addresses design and construction of automotive fueling stations with above ground fueling systems to replace existing 30-year-old facilities at Harmon Yard, Brewster North Yard and North White Plains Yard. While there is sufficient property for Harmon and Brewster North Yards, the North White Plains Yard site requires the acquisition of private property adjacent to the existing Yard. This strategic location will offer significant safety benefits by relocating the new fueling station away from Yard traffic and allowing for the safe and efficient flow of vehicles. This public hearing includes property interests needed for the Project.

Public Hearing Format

This will be a hybrid hearing with in-person participation as well as via Zoom’s online platform and conference call feature, with a livestream available on this website. Those interested in speaking must pre-register to speak at the public hearing. Each registered speaker will have three (3) minutes to speak.

Those wishing to be heard at the Public Hearing must register on the website, verbal comments will be limited to three (3) minutes.  You may present verbal testimony or submit written statements in lieu of or to supplement oral testimony concerning the proposed project. Written comments will be accepted online. All written and online comments must be received by 5:30 p.m. on April 7, 2023. Comments received after this date and time will not be considered.

Any property owner or other interested party who may wish to challenge the proposed property taking via judicial review may do so only on the basis of issues, facts, and objections raised at the EDPL public hearing.
